I'm not sure how an email could legally qualify to be a fax...the reason the
law was written wasn't so people didn't have to look at things they didn't
wan't to, but to keep marketing companies from using up the recipient's paper.
A fax is unique in that unlike junk snail mail or email it costs the recipient

to get it (Perhaps the law dates from the days when users were charged by the
amount of email they received--I don't think any major ISP does that any more,
they just limit the size of the mailbox, and I doubt many people's mailboxes
ever fill up unless they ignore it for a while). Email should fall into the
same class as junk snail mail; if you don't wan't a sender to send you ads,
just notify the sender and then it's a violation if it continues. It should
not be a crime to send email just because it's unsolicited. I don't want to
wade through 80 ads to get to 1 "meaty" message, but if it's the other way
around I'm not offended at all. When I see an ad here and there I don't see a
nuisance, I see people working. Advertising provides jobs, and there'd be a
lot fewer jobs if people had to give explicit permission to be exposed to
advertising. Sorry, the occasional spam doesn't bother me a bit; I just hit
the "next" button if I'm not interested.
